      <title>Penalties for missing the tax return deadline</title>

	<strong>If you miss the deadline, the longer you delay, the more you&#39;ll have to pay.&nbsp; It is important to send your tax return to HMRC as soon as you can.&nbsp; The table below shows the penalties you&#39;ll have to pay if your tax return is late.&nbsp; If a Partnership tax return is late, each partner will have to pay the penalties shown below.</strong></p>

	We have recently been asked by a Doctor about how to recover the cost of subscriptions back on a Tax Return.</p>

	We advised that there are a number of ways to do this but that the main two would be to claim it back through your tax code or to do a tax self-assessment return.</p>

	We also advised that there may be relief on other job related expenditure which lot of doctors don&rsquo;t claim from the tax office.</p>

      <title>Increased VAT Rates</title>

	Standard Rate Vat Increase<br />
	<br />
	On the of 4th January 2011 the standard rate of VAT will increase from 17.5% to 20%.<br />
	<br />
	Goods/services provided before the change<br />
	<br />
	The new rate generally applies to all VAT invoices issued by a business on or after 4th January 2011. However, where a business issues an invoice on or after 4th January 2011 and the goods or services were provided prior to 4th January 2011, the business may apply VAT at 17.5%.<br />
	<br />
	Goods provided after the change<br />
	<br />
	If a business has received a payment or issued an invoice before 4th January 2011 but the goods will be provided (or services delivered) after 4th January 2011 then the supplier has a choice, either:<br />
	<br />
	&nbsp;to leave the VAT charged at 17.5%; or<br />
	&nbsp;to account for VAT at the new 20% rate.<br />
	<br />
	Accountancy Software &amp; EPOS Tills<br />
	<br />
	Most accountancy software and EPOS tills will have the ability to update the standard VAT rate &ndash; however it may be preferable to create a new VAT rate as the old may not be required for some time.<br />

	Providing the annual costs of functions in a tax year is less than &pound;150 (inc vat) then there are no tax implications for the employees &ndash; however it is important that all costs associated are taken into account (transports, accommodations, meal, drinks and so on).</p>

	The likelihood is that as a self-employed locum, earning 70k to 90k per year that you would be better to look at setting up a limited company. By doing this you may be able to benefit from tax savings as well as a greater degree of personal security.<br />

	<img alt="Wesley Snipes" src="http://www.khan-thornton.co.uk/images/uploads/wesley-snipes.png" style="width: 150px; height: 215px; float: right;" />Blade actor Wesley Snipes is to serve a custodial sentence of three years for tax evasion in the US, an appeal court has ruled.<br />
	<br />
	The US actor earned more than $37m (&pound;24m) between 1999 and 2004 but failed to file any income tax returns during that period, according to official court papers, the BBC reports.</p>
<p>
	In February 2008 Snipes was found guilty of failing to file tax returns to the US Inland Revenue. He was sentenced in April and launched an appeal in May.<br />
	<br />
	It is not yet known when the custodial sentence will take place or whether it will be in his hometown of Florida or where his original trial took place in New York.</p>
<p>

      <title>Overpaid tax could run to £3bn</title>

	The taxman is struggling with 18 million cases of overpaid and underpaid tax amounting to tax payers contributing &pound;3bn more than they should done.</p>
<p>
	A report on HM Revenue &amp; Customs from the National Audit Office said: &quot;The exact amounts of tax over and underpaid and the number of individuals affected cannot be determined until these cases are resolved. Reducing this backlog of cases remains a very significant challenge.&quot;</p>
<p>
	Commenting directly NAO chief Amyas Morse said: &quot;The department has not made enough progress in reducing the backlog of 18.2 million income tax cases where there is potentially overpaid or underpaid tax. It also needs to improve its collection rate for tax credits debts, which substantially lower than that for tax debts.&quot;</p>
<p>
	More also said HMRC needed to develop its information systems needed to be developed to properly monitor the success of its campaigns targeting the collection of specific taxes.</p>
<p>
	He said HMRC had been affected by the recession which had increased the value of tax debt to be recovered while at the same time coming under pressure to streamline because cost cutting.</p>
<p>
	2009-10 saw HMRC collect &pound;435.1bn, down 1.3% on 2008-09. Amounts due, but not yet paid stood at &pound;26.1bn.</p>

	This was according to the latest Red Flag Alert statistics for the second quarter of this year from restructuring specialists Begbies Traynor.<br />

	The report found that although the numbers of companies experiencing distress have fallen (by 21% compared to 161,601 in Q1 2010 and by 31% compared to previous peak levels of 185,813 in Q2 2009), they remain at historically high levels (up 15% from 111,089 in Q2 2008).</p>

	<a href="http://www.hmrc.gov.uk/index.htm" target="_blank">HMRC</a> announced in June that the Extra Statuory Concession B46 (ESC B46) allowing a seven-day grace period for late employers&rsquo; and contractors&rsquo; returns will cease from 31 March 2011.<br />
	<br />
	Introduced in 1995, ESC B46 established the principle that penalties would not be charged when employers and contractors submitting tax returns and CIS forms had taken &ldquo;all reasonable steps&rdquo; to file their returns on time, but were not able to do so due to unforeseen circumstances such as postal delays.<br />
	<br />
	With the advent of online filing, which is required for P35s and P14s and will become mandatory for Corporation Tax returns from 1 April, <a href="http://www.hmrc.gov.uk/index.htm" target="_blank">HMRC</a> considers the concession to be &ldquo;redundant&rdquo; because the delays it was intended to address will no longer happen. Returns must therefore reach the department by their due date or incur a late filing penalty of &pound;100.<br />
	<br />
	Confirming the new penalty regime in the <a href="http://www.hmrc.gov.uk/briefs/company-tax/brief2410.htm" target="_blank">Revenue &amp; Customs Brief 24/10</a>, the department explained: &ldquo;Any customers filing a return late will, as now, be able to request us to remove any penalty, if they believe they had a reasonable excuse for the delay in filing. We will consider every case on its own merits. Customers can also appeal against the penalty to a Tribunal.&rdquo;</p>

	&quot;Football club <a href="http://www.southendunited.co.uk/page/Welcome" target="_blank">Southend United</a> has 14 days to prove it is solvent or face administration, a court heard yesterday.<br />
	<br />
	The club was handed a stay of execution by the courts yesterday, despite <a href="http://www.hmrc.gov.uk/index.htm" target="_blank">HMRC</a> seeking the appointment of administrators.<br />
	Advertisement<br />
	<br />
	HMRC petitioned the High Court to wind up <a href="http://www.southendunited.co.uk/page/Welcome" target="_blank">Southend United</a> yesterday for non-payment of &pound;238,710 in tax.<br />
	<br />
	<a href="http://www.southendunited.co.uk/page/Welcome" target="_blank">Southend United</a> is also facing another winding up petition next week from <a href="http://www.charterhouse.co.uk/default.asp?sID=1129021600775" target="_blank">Charterhouse Commercial Finance</a> for &pound;140,000.<br />
	<br />
	<a href="http://www.hmrc.gov.uk/index.htm" target="_blank">HMRC</a> said the club&#39;s history of failing to pay its taxes demonstrated it was insolvent.<br />
	<br />
	The High Court has given the club until 2 August to prove it is solvent and able to continue trading.&quot;</p>
